An offence must occur for an arrest to happen. It’s not illegal to be schizophrenic, as much as you would like it to be.

Are you suggesting they be rounded up wholesale and we go back to warehousing people in institutions?

They keep getting released and if they dont take their meds then you get what happens.

They keep attacking and killing innocent people, get slapped with a NCR and out on the streets where they don't take their meds and there it goes again.

At some point the safety and security of a functioning society should take priority, no?

There’s some good lawyers out there that would help them out of these trouble. Oh the human rights groups would have an outcry.

Look I'm not saying lock these folks up and throw away the key. But there needs to be a better solution out there rather than the public at large be at a constant danger of being attacked by severily mentally ill people who are also often addicted to hard drugs.

Where did you pick up the false equivalency that being found NCR is an automatic freedom ticket?

Toronto Star: How often should the Eglinton LRT run? TTC, Metrolinx disagree

Metrolinx wants to run higher frequency service (as often as every 3 minutes, 10 seconds), while the TTC who will be operating the service, in light of reduced ridership from the pandemic wants to initially run it at 5 minutes all day increasing along with ridership.  Given the delays, I can see Metrolinx trying to get the optimal service from the start.  The TTC on the other hand is in a funding crunch due to the reduced ridership.  This will be the first joint project in the GTA and people are closely watching how the partnership will play out for the rest of the projects.

I'm not so sure that Metrolinx is doing this out of the goodness of their hearts.

 

As I understand the contract is written, the TTC needs to pay for the use of the vehicles and the line based on the service level. Reduced frequencies means more vehicles, which means higher costs. And considering that as new there should be virtually no major maintenance needed to be performed - which is what those payments are supposed to help cover - Metrolinx would pocket the difference.

 

Yes, the TTC is currently undergoing a funding crunch, but they certainly aren't the only ones, either.

BlogTO just reported (Is BlogTO an approved media outlet around here?) on this one that took place a month ago.  The police suspect the same person also harmed others so who knows what else beyond whipping the coffee at that lady on the subway he’s done.

I haven't been using the subway much lately.  Any feet on the ground reports of franchisees folding shops in the stations?

They're always getting robbed too. I hear that several times a week on the TTC radio.

The one at Kennedy Station is still up & running.

In other news, the woman who was pushed to the subway tracks and survived the ordeal, has filed a lawsuit against the TTC for $1M.

I usually hate frivolous lawsuits and ambulance chaser type cases, but I think she is right in this case. The city and the TTC has allowed the subway system to be an underground mental asylum, where the homeless, junkies and all kinds of psychos are free to roam and terrorize the public..

 

Maybe this will bring some light to the problem that needs to be addressed on a wider scale.

Yes, and in return millions of other stupid kids couldn't see the stupidity and instantly try to repeat it.

The stupidity stayed mostly local. It didn't lead to the stupidity of TikTok challenges.

"Lawyers for the TTC also claim the victim shares blame for the incident because "she was travelling alone and unassisted on public transit when she knew or ought to have known that it was unsafe for her to do so.""

Halfway through 2022, the TTC tacitly mounts an argument that women should be chaperoned while riding the subway.  Unbelievable.

As immoral as the lawyers for the TTC sound to dismiss her claim as “her fault” it’s always done this way to ensure the agency has no fault in this situation and doesn’t have to pay out anything to the victim. I don’t agree with their counter argument but that is the norm. It’s their job to save the commission money from frivolous lawsuits.

It's not the TTC's fault that politicians don't want to fund platform screen doors. A significant population thinks moneys should go towards metal health instead of this sort of protection too. Maybe she should sue the government and those advocates too.

It is also common for 1950s built station to future narrow platforms without platform screen doors around the world. So it's not unreasonable to say the TTC didn't do enough.

For the victim, their lawyers would always sue the organization/person that is most likely be able to afford to pay. Hence why the TTC is targeted more instead of the mentally ill suspect. that person can't pay the damages even if the victim succeeds. If a homeless burns down a building, good luck to the insurance agencies.

Victim-blaming at its finest. Just because you're standing too close to the edge of the platform doesn't mean you're "asking for it" (to be pushed). Granted, it's not fair to place 100% of the blame on the TTC either, instead of the perpetrator and whatever was going through their head when they chose to do what they did (I won't get into the whole "mental health" vs. "pure evil" debate – whether the perpetrator is just a "bad person" or a "victim" of unfortunate circumstances is a topic for another thread, and probably another forum).

But the TTC's lawyers openly saying that it is unsafe to travel on the TTC alone & unassisted, and that passengers should know better, is not only blaming the victim, but also counterproductive to the case of the party they're supposed to be defending (the TTC). All they're doing is giving the TTC bad PR ("we know it's unsafe, but fuck-all will be done about that, instead passengers have to travel at their own risk"). Unfortunately not everyone has a travel buddy / group / bodyguard to accompany them everywhere they go.?

They’re Lawyers. It’s what they do.

There’s a standard playbook of tactics to litigation cases like these, for both the plaintiff and defendant.

It doesn’t mean their argument will stick. Each side will go back and forth, and a settlement sum will be struck somewhere down the middle, probably with an NDA attached.

You really believe the spin the media puts on this stuff? It's easy to see she was standing too close to the edge. Not her fault for getting pushed, but she could have prevented it by not standing so close. Everybody should be free to stand as close to a 800,000lb vehicle moving at 50km/h without harm, but why do so? Why take that risk with your personal safety? Just to be the first one on to get that coveted seat covered in stale urine?

 

2 lawyers, $1M lawsuit, how much will she end up with after costs? Not worth it.
